Rockland County District Attorney Thomas E. Walsh II announced that on February 24, 2026, Daquan Kelly, 32, of the Village of Haverstraw, pleaded guilty to Criminal Possession of a Weapon in the Second Degree, Criminal Possession of a Weapon in the Third Degree, and Resisting Arrest before the Honorable David M. Ascher.
According to prosecutors, on July 24, 2025, at approximately 11:00 p.m., Kelly was found in possession of a loaded firearm. When officers attempted to take him into custody, he allegedly resisted arrest by twisting his body, flailing his legs, and throwing himself to the ground in an effort to avoid being placed into a police vehicle.
Authorities noted that Kelly has a lengthy criminal history, including a 2022 conviction for Criminal Contempt in the Second Degree, a 2015 felony conviction for Attempted Robbery in the Second Degree, and a 2012 felony conviction for Robbery in the Third Degree.
Kelly is scheduled to be sentenced on June 9, 2026. The People have recommended a sentence of 10 years in state prison. The Court is expected to impose eight years on the top count of Criminal Possession of a Weapon in the Second Degree, two to four years in state prison on the third-degree weapon charge, and one year on the Resisting Arrest charge, with all sentences to run concurrently.
“I commend the officers for their vigilance and swift action in taking this individual into custody,” said District Attorney Walsh.
The case was investigated by the Town of Haverstraw Police Department with assistance from the Rockland County Sheriff’s Department and was prosecuted by Executive Assistant District Attorney Michael Peterson.
