Rockland County District Attorney Announces Court Again Rejects Amer Zada’s Attempt to Overturn 1980 Murder Conviction

Rockland County District Attorney Thomas E. Walsh II announced that the Appellate Division of the New York State Supreme Court has once again denied an appeal attempt by convicted murderer Amer Zada. In a decision dated July 1, 2025, the court rejected Zada’s request to overturn the denial of his latest motion to vacate his decades-old conviction.

This marks the ninth time Zada has tried to challenge his conviction, all of which have been unsuccessful. Earlier this year, Rockland County Court Judge Kevin F. Russo ruled that Zada failed to present any new or credible evidence that would justify vacating the conviction.

Zada was found guilty in 1980 of brutally murdering 17-year-old Shirley Smith in a Nyack parking lot. He was represented at trial by famed civil rights attorney William Kunstler, known for defending high-profile and controversial figures.

“This latest decision reaffirms that Zada’s claims are baseless and unworthy of further judicial review,” said DA Tom Walsh. “Our office remains steadfast in defending justice at every level of the appellate process. I especially want to commend Executive Assistant District Attorney James Dolan for his tireless advocacy and unwavering commitment to this case. Even 45 years later, EADA Dolan’s efforts are a testament to the dedication and integrity of our entire legal team.”

Rockland County District Attorney Walsh said the ruling delivers continued justice for the victim’s family and further reinforces the strength and integrity of the original prosecution.
