New York Attorney General Letitia James’ Office of Special Investigation (OSI) has released its report on the fatal shooting of Rakim Tillery by New York State Police (NYSP) troopers on January 3, 2024, during a traffic stop on the New York State Thruway in Ramapo, Rockland County, as Monsey Scoop reported the story back then.
Following an extensive investigation—including witness interviews, a review of home and body-worn camera footage, and legal analysis—OSI concluded that the officers’ actions were legally justified. The report found that a prosecutor would not be able to disprove beyond a reasonable doubt that the use of deadly force was necessary under New York law.
The incident unfolded at approximately 2:53 p.m. when two NYSP troopers pulled over a vehicle in connection with an earlier incident in Albany. As the officers approached, the driver, Mr. Tillery, exited the vehicle armed with a firearm and fired at the troopers. One trooper returned fire, causing Mr. Tillery to fall. As an officer approached, a struggle ensued, during which Mr. Tillery attempted to grab the trooper’s weapon. The second trooper then discharged his service weapon three times, fatally striking Mr. Tillery.
Under New York law, officers are permitted to use deadly force when they reasonably believe it is necessary to protect themselves or others. Given the circumstances of the encounter, OSI determined that the use of force was legally justified, and no criminal charges will be filed.
