In the early hours of January 8, 2024, Haverstraw Police Department officers responded to a call regarding a suspicious individual at the Wendy’s parking lot in West Haverstraw. At approximately 1:00 am, officers arrived at the scene to investigate reports of a male wearing a ski mask.
Upon arrival, police encountered Michael Perez Leiva, a 22-year-old resident of Nanuet. During the interaction, officers discovered Leiva in possession of a loaded firearm. Further investigation led to the discovery of a large capacity ammunition feeding device.
Leiva faces multiple charges, including criminal possession of a weapon in the second degree for the loaded firearm and third degree for the ammunition device. Additional charges include resisting arrest, obstructing governmental administration in the second degree, and aggravated unlicensed operation of a vehicle in the third degree.
Following his arrest, Leiva was arraigned at the Village of West Haverstraw Justice Court. The court has remanded him to the Rockland County Correctional Facility, with bail set at $5,000.
The Haverstraw Police Department emphasizes that a criminal complaint is only an accusation. As per legal standards, the defendant is presumed innocent until proven guilty in a court of law.
